Welcome to HerbalGH. By accessing or using our website, mobile experience, or any services provided by HerbalGH ("we," "us," "our"), you agree to be bound by these Terms & Conditions and our Privacy Policy.

If you do not agree with any part of these terms, you should not use our platform. Continued use of HerbalGH after any changes to these terms constitutes your acceptance of the revised terms.

HerbalGH is an online directory and marketplace that connects consumers in Ghana with producers of herbal medicines and natural wellness products. All products listed on HerbalGH are approved by Ghana's Food and Drugs Authority (FDA).

HerbalGH facilitates the discovery, comparison and purchase of herbal products but does not manufacture the products themselves. Each product is provided by its respective producer, who bears primary responsibility for product quality, ingredients, labelling and regulatory compliance.

To use HerbalGH, you must be:

• At least 18 years of age, or the age of majority in your jurisdiction;
• Capable of forming a legally binding contract under applicable law;
• Not prohibited by law from receiving the services we provide.

If you are acting on behalf of an organisation, you represent that you are authorised to bind that organisation to these terms.

Creating an account is optional for browsing, but may be required to complete purchases, track orders or save preferences. You agree to:

• Provide accurate, current and complete information during registration;
• Maintain the confidentiality of your password and account credentials;
• Notify us immediately of any unauthorised access to your account;
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users or our platform.

When you place an order on HerbalGH, you are making an offer to purchase the selected product(s). We reserve the right to accept or decline any order at our discretion.

We accept the following payment methods:

• Mobile Money (MoMo) — MTN, Vodafone, AirtelTigo;
• Paystack — cards and bank transfer;
• Pay on Delivery — available in select locations.

Prices are displayed in Ghana Cedis (GHS) and are inclusive of applicable taxes unless stated otherwise. Delivery fees are calculated at checkout based on your location.

All payments are processed securely. HerbalGH does not store your full payment details; card payments are handled by Paystack, and mobile money payments are processed through official networks.

We deliver to all 16 regions of Ghana. Estimated delivery times are:

• Within Accra: 1–2 business days;
• Other regions: 2–5 business days;
• Remote areas: up to 7 business days.

Delivery times are estimates and not guarantees. Delays may occur due to courier availability, weather, or circumstances beyond our control. We will keep you informed of any material delays.

Risk of loss and title for products pass to you upon delivery to the address specified at checkout. Please ensure someone is available to receive the order, or arrange an appropriate delivery instruction.

Due to the nature of herbal medicines and consumable products, our returns policy is as follows:

• Unopened products in their original, sealed packaging may be returned within 7 days of delivery;
• Opened or tampered products cannot be returned for health and safety reasons;
• Damaged or incorrect items must be reported within 48 hours of delivery, with a photo of the item and its packaging.

Refunds are processed within 3–5 business days of receiving the returned item. Mobile money refunds arrive instantly after processing; card refunds may take up to 7 business days to reflect in your account.

Return shipping costs are the responsibility of the customer unless the return is due to our error (e.g., damaged or incorrect item).

While we work only with FDA-approved producers and verify regulatory compliance before listing, HerbalGH does not make medical claims about any product. Traditional uses described on product pages reflect the producer's representations and are not clinical endorsements by HerbalGH.

If you experience an adverse reaction to any product purchased through HerbalGH, stop use immediately, seek medical attention, and report the reaction to us via the Contact page. We take all reports seriously and may notify the producer and FDA as appropriate.

When using HerbalGH, you agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law;
• Impersonate any person or entity, or misrepresent your affiliation;
• Interfere with or disrupt the platform, its servers, or connected networks;
• Attempt to gain unauthorised access to any part of the platform or its systems;
• Upload or transmit malicious code, spam, or content that infringes the rights of others;
• Harvest, scrape or collect user data without express permission;
• Post false, misleading or defamatory reviews or feedback.

All content on HerbalGH — including text, graphics, logos, icons, images, audio, video, software and the selection and arrangement thereof — is the property of HerbalGH, its licensors, or content providers, and is protected by Ghanaian and international copyright, trademark and other intellectual property laws.

You may view, download and print content from the platform for your personal, non-commercial use, provided you retain all copyright and proprietary notices. Any other use — including reproduction, modification, distribution or republication — requires our prior written consent.

Product images and descriptions supplied by producers remain the property of those producers, and are used by HerbalGH under licence.

By submitting a review, testimonial, feedback or other content to HerbalGH, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, publish and display that content in connection with our services.

You represent that any content you submit is:

• Your own original work, or that you have the right to submit it;
• Truthful and based on your actual experience;
• Free of offensive, defamatory, misleading or unlawful material.

We reserve the right to moderate, edit or remove any content at our discretion, including reviews that violate these terms or our community standards.

To the fullest extent permitted by law, HerbalGH and its directors, officers, employees, agents and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages — including loss of profits, data, goodwill or other intangible losses — arising from:

• Your use of or inability to use the platform;
• Any conduct or content of any third party on the platform;
• Any content obtained from the platform;
• Unauthorised access to, use of, or alteration of your transmissions or content.

Our total liability for any claim arising out of or relating to these terms or your use of HerbalGH will not exceed the amount paid by you to HerbalGH in the six months preceding the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited under applicable law, including liability for death, personal injury caused by negligence, or fraud.

You agree to indemnify, defend and hold harmless HerbalGH, its affiliates, and their respective officers, directors, employees and agents from any claims, liabilities, damages, losses and expenses — including reasonable legal fees — arising out of or connected with:

• Your use of the platform;
• Your violation of these terms;
• Your violation of any rights of another party;
• Any content you submit to the platform.

We may suspend or terminate your access to HerbalGH, with or without notice, for any reason, including:

• Breach of these Terms & Conditions;
• Fraudulent, abusive or unlawful activity;
• A request by you to close your account.

Upon termination, your right to use the platform will cease immediately. Provisions that by their nature should survive termination — including those relating to intellectual property, liability and governing law — will continue in effect.

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these terms or your use of HerbalGH will be subject to the exclusive jurisdiction of the courts of Accra, Ghana. You waive any objection to venue or jurisdiction in those courts.

We may update these Terms & Conditions from time to time to reflect changes in our services, legal requirements or business practices. When we do, we will revise the "Last updated" date at the top of this page.

For material changes, we will provide notice through the platform or by email (where we have your address on file) at least 14 days before the changes take effect. Your continued use of HerbalGH after the effective date constitutes acceptance of the updated terms.
